1. Acceptance and Scope
By accessing or using GainDesk, you agree to these Terms of Service. If you use GainDesk for a business or other organization, you confirm that you have authority to accept these terms for that organization.
GainDesk is intended for business use by fitness coaches and related businesses. You are responsible for ensuring that your use of GainDesk is permitted under the laws, platform rules, and agreements that apply to you.
2. Service Description
GainDesk provides a workspace for organizing Instagram direct-message conversations, tracking prospects, preparing replies, creating follow-up tasks, and generating internal sales insights. Some workspaces may also use AI-assisted analysis, suggested replies, automatic replies when enabled, subscription, billing, and administrative features.
The available features may depend on your workspace configuration, connected accounts, selected plan, and the availability of third-party services.
3. Instagram Professional Account Integration
Connecting Instagram is optional. GainDesk uses Instagram API with Instagram Login for professional accounts. You may connect only an Instagram account that you are authorized to manage.
Your use of Instagram and Meta services remains subject to the applicable terms and policies provided by Meta and Instagram, including the Meta Platform Terms. GainDesk is not responsible for changes made by Meta or Instagram to their services, permissions, review requirements, or API availability.
4. Your Responsibilities
You are responsible for:
- using GainDesk only for accounts and workspaces you are authorized to manage;
- ensuring that your messages, follow-ups, offers, and business practices comply with applicable law and platform rules;
- reviewing messages, drafts, internal records, and configuration before relying on them or sending communications;
- responding appropriately to privacy, deletion, and other lawful requests involving people who communicate with your business; and
- keeping your workspace information accurate and reasonably up to date.
5. AI-Assisted Features
GainDesk may use AI-assisted features to analyze conversations, prepare summaries, identify sales signals, or suggest replies. AI-generated output may be incomplete, inaccurate, or unsuitable for a particular situation. You are responsible for reviewing output before relying on it.
Automatic replies are used only when an authorized workspace user enables available autopilot functionality. You remain responsible for configuring, monitoring, and using that functionality appropriately. GainDesk does not guarantee sales, conversion, or business results.
6. Account Security and Access
You are responsible for protecting your account credentials and limiting workspace access to authorized people. Do not share passwords, Instagram access tokens, or other sensitive credentials through GainDesk messages, notes, or support requests.
If you believe that your workspace or connected Instagram account has been accessed without authorization, use the GainDesk support channel through which you communicate with GainDesk and take appropriate steps to protect the affected account.
7. Connected Account Removal and Data Handling
A workspace user can remove a connected Instagram account from the GainDesk settings page. Removing or deauthorizing an Instagram connection stops future authorized use of that account token. Existing workspace conversations or business records may remain unless a deletion request is made and applicable retention obligations permit deletion.

8. Plans and Billing
If you select a paid plan, billing information and payment operations are handled through Stripe. The plan details and applicable commercial terms presented during checkout or within the service apply to that purchase. Available billing controls may be provided through GainDesk or Stripe.
9. Prohibited Use
Do not use GainDesk to:
- access or manage an account without authorization;
- send spam, harassment, deceptive messages, or unlawful communications;
- violate another person's privacy, intellectual property, or other rights;
- upload, transmit, or attempt to introduce malicious code or interfere with the security or operation of the service;
- attempt to bypass access controls, inspect another workspace's data, or misuse integration credentials; or
- use GainDesk in a way that violates applicable Meta or Instagram rules.
10. Availability, Changes, and Access Restrictions
GainDesk may update, add, limit, or remove features as the service evolves. Service availability may also be affected by maintenance, security work, and third-party services such as Meta, Instagram, Supabase, Anthropic, or Stripe.
GainDesk may restrict access when reasonably necessary to protect the service, respond to security concerns, comply with legal obligations, or address misuse of the service.
11. Changes to These Terms
These Terms of Service may be updated from time to time. The date at the top of this page indicates when they were last revised. Material changes should be communicated as appropriate for the nature of the update.
